Legal Entity: Naughty Cocktail Parties (“NCP,” “we,” “us,” “our”)

1) Acceptance of These Terms

By accessing our websites, replicated consultant sites, landing pages, forms, events, SMS/MMS programs, or purchasing products/services (collectively, the “Services”), you agree to these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use the Services.

2) Eligibility (Adult Content)

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services or purchase products. By using the Services, you represent and warrant you meet this requirement.

3) Changes to the Terms

We may update these Terms periodically. Continued use after changes constitutes acceptance. The “Last updated” date will reflect the latest revision.

4) Accounts; Accuracy of Information

You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your credentials and all activity under your account.

5) Orders, Payments & Shipping

Availability & Pricing: Products, bundles, and pricing may change at any time. Taxes and shipping are calculated at checkout.
Payment Processing: Payments are processed by our payment partners (e.g., Authorize.Net). By purchasing, you authorize us to charge your selected payment method.
Fulfillment: Orders typically ship within posted timelines; delays may occur. We may ship items separately. Title and risk of loss pass upon carrier acceptance.
Address Accuracy: You are responsible for providing a correct shipping address. We are not liable for misdelivery due to inaccurate information.
Discreet Packaging: We endeavor to use discreet packaging when possible; actual packaging may vary by carrier and warehouse.

6) Returns, Exchanges & Hygiene Policy

Final Sale for Opened Items: Due to the intimate nature of our products, opened or used items are not returnable unless defective under applicable law.
Unopened Returns: Unopened items in original, sealed packaging may be eligible for return within the posted return window (restocking fees may apply).
Defects & DOA: For manufacturer defects upon arrival, contact support with photos/video within the posted time frame for assistance.
Health & Safety: For safety and hygiene, we cannot accept returns that have been opened, used, or lack original safety seals.

7) Product Information, Safety & No Medical Advice

Product descriptions are provided for informational purposes only. We do not provide medical advice. Consult a qualified professional regarding any health concerns. Always read and follow product instructions, warnings, and care guidelines.

8) Party Hosts, Events & Age Verification

Age Requirement: All attendees must be 18+ (or the age of majority where the event is held). Hosts are responsible for ensuring compliance.
Venue Rules: You agree to comply with venue and local regulations. We may refuse or terminate an event for safety, legal, or policy reasons.
Photography/Content: Where permitted, photos or testimonials submitted may be used per Section 12 (User Content & Licenses).

9) Consultant Program & Replicated Sites

Enrollment & Policies: Participation is subject to separate Consultant Program Terms/Policies, which govern commissions, qualifications, and conduct.
Attribution: Orders placed via replicated consultant sites or attributed links/UTMs are credited per program rules. Corporate-site orders may be assigned per policy.
Non-Commissionable Items: Certain SKUs (e.g., business supplies) may be non-commissionable and excluded from CV/QV.
Adjustments & Audits: We may review orders and adjust credits/commissions for returns, fraud, policy violations, or attribution errors.

10) Acceptable Use

No misuse, interference, scraping/harvesting, malware, unauthorized access, infringement, or unlawful/harassing/deceptive activity. Do not upload or transmit content that is illegal, obscene (beyond lawful adult materials), defamatory, or violates rights of others.

11) Intellectual Property

All content, trademarks, designs, and software are owned by NCP or its licensors and protected by law. Except as expressly permitted, you may not copy, modify, distribute, or exploit any portion without prior written consent.

12) User Content & Licenses

Submissions: You represent you own or have permission to submit reviews, photos, testimonials, or other materials (“User Content”).
License: You grant NCP a worldwide, royalty-free, sublicensable license to use, reproduce, edit, publish, distribute, publicly perform and display User Content to operate and promote the Services.
Releases: You are responsible for obtaining necessary consents, including for any identifiable individuals.

13) Mobile Messaging (A2P/10DLC) Terms

Programs: Orders, shipping updates, party/event info, consultant communications, promotions, and support.

Opt-In Methods: Consent checkbox on forms; texting our published keywords; scanning a QR code to an opt-in form; or verbal consent at an event followed by confirmation.

Message Frequency: Varies by interaction (typically 0–8 msgs/month) plus replies to your inbound texts.

Costs: Message & data rates may apply. Carriers are not liable for delayed or undelivered messages.

Help: Text HELP or email [email protected].

Opt-Out: Text STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. We will send one confirmation message and then stop for that program unless you opt back in.

Consent & Privacy: By opting in, you consent to receive autodialed/prerecorded messages; consent is not a condition of purchase. See our Privacy Policy.

14) Third-Party Services & Links

We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.

15) Disclaimers

The Services and products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

16) Limitation of Liability

To the fullest extent permitted by law, our aggregate liability shall not exceed the greater of $100 or amounts you paid for the product/service at issue within the prior 3 months.

17) Indemnification

You agree to defend, indemnify, and hold NCP harmless from claims arising out of your use of the Services, your User Content, your participation in the Consultant Program, or your violation of these Terms or law.

18) Governing Law; Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws rules. Except for small-claims or injunctive relief, disputes shall be resolved by binding arbitration seated in Pennsylvania under AAA rules. Class-action and jury waivers apply. Any claim must be brought within 1 year.

20) Termination

We may suspend or terminate access at any time. Sections intended to survive will survive.
